Texas Divorce Records

By Claire Dowell

The implementation of the Freedom of Information Act has mandated the government to make divorce files open to the public. The Vital records section of the Department of Health Services in Texas manages the state's public records including Texas divorce records.

In Texas, divorce records are used in processing legal concerns such as planning to marry again. One will also be required to present their divorce record when migrating to a different country. It is also used to check the status of their partners. This helps them to know whether the separation was done legally. By doing so, one can avoid problems when there is a plan to marry again.

The divorce certificate would contain the names of the bride and groom who got divorced. It also indicates the place and date of their marriage. Important information about the separation is detailed on the file. Such information includes the date and place they legally separated. A public divorce record, however, does not disclose the reason for the divorce. This is done to respect the privacy of the people behind the separation. Information related to the asset division and custody of the child is not indicated on the public record. In addition to the said limitations, the public are not allowed to request for a certified copy of the divorce decree.

Since 1968 when the divorce records were made into public documents, the payment for the retrieval of the divorce files is still at $20 per copy. It is a non-refundable fee which means that if there are no records found, the payment is not refunded. It would take the office several days to obtain a copy of the record. Mail request can be done to obtain the file. However, using this option would have additional charges and the retrieval of the file would take even longer.

Obtaining a copy of a divorce certificate in Texas can be done in a number of ways. One can file the request through a mail order or go straight to the office of the Vital Records Section. The latter option is faster than compared to a mail request. There are now third party companies who offer to search for the record for you for a certain fee. The most popular method chosen by many is by going online and retrieving the record on your own.

The development of the Internet has made the government transactions convenient and faster. Texas divorce records can now be obtained from accredited websites. One can even choose from a free divorce records search or a paid search. Free search, unfortunately can give raw information that may need processing before it can be used. Paid searches on the other hand can provide a complete, accurate and ready to use document. They even offer a money back guarantee option if there are no records found.
